General

The use of the Company's Websites, Phone Sales and Retail Establishments is governed by the Terms and Conditions set forth below. By using the Company's Website, Products, Facilities and Service Outlets, you agree to these terms of use. If you do not agree to these terms of use, you may not use these resources. We reserve the right to modify, alter or update these Terms of Use, and you agree to be bound by such modifications, alterations and updates.

The Company

The term "the Company" refers to Darkhorse Wheel & Traction Corporation, a Texas Corporation doing business as "Motorcars Ltd", "Motorcars-LTD", "British Parts International", or "Black Dog Manufacturing Company".

Pricing

Pricing applies to website & phone-in parts purchases only. Website pricing is NOT available through any Motorcars, Ltd. Service Center. Service customers please see Service Terms. Prices subject to change without notice.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, the Company shall have the right to refuse or cancel any orders placed for merchandise listed at the incorrect price. The Company shall have the right to refuse or cancel any such orders whether or not the order has been confirmed.

Copyright

Everything found at the Company's Websites is copyrighted unless otherwise noted, and may not be used except with the Company's express written consent. Use of our HTML, images, and or ideas and concepts by you or third parties for purposes other than those expressed or implied is strictly prohibited and may violate the copyright laws, trademark laws, privacy laws and other laws and regulations. Nothing contained in this site may be construed as granting any license or right to use any of our trademarks or service marks without prior written consent.

Trademarks

All trademarks, service marks and trade names (collectively called the "marks") that appear on our site are proprietary to the Company or other respective owners that have granted the Company the right and license to use such marks.

Disclaimer

All information, services, products and materials contained in this site, including text, graphics and links are provided on an "as is" basis with no warranty. To the extent permitted by law, the Company disclaims all representations and warranties, expressed or implied, with respect to such information, services, products and materials particular purpose, title, non-infringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance. The Company does not represent or warrant that information accessible via this site is accurate, complete or current. Price and availability information is subject to change without notice.

Order Acceptance

The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. The Company reserves the right, without prior notification to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order.

Limitation of Liability

The Company will not be liable for any direct, indirect, special, punitive, incidental, exemplary, or consequential damages whatsoever, even if the Company has been previously advised of the possibility of such damages whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from the Company's Website, Products, Facilities, and Service Outlets. These limitations will apply notwithstanding to any failure of essential purpose of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.

Currency

All prices are in U.S. dollars.

Jurisdiction

All payments to the Company are due and payable in Harris County, Texas in U.S. dollars. It is agreed that all disputes are subject to Texas law and applicable federal law and will be filed and presented to Texas courts in Harris County, Texas.

Labor

The Company will not refund any labor costs incurred by the buyer or the installer of the products purchased at Company's website, Facilities and Service Outlets.

Paypal Payment Policy

Motorcars Ltd requires a Confirmed address and Verified Account when using the PayPal Payment Option.

PayPal Payment Option may not be used for International Shipments.

Credit Cards

Credit Card Authorization Form:

For credit card orders over $500, we must have a credit card authorization form on file. This form can be completed via fax call 1-800-338-5238 for your Credit Card Authorization Form today.

Cardholder Authorization and Statement

Customers purchasing goods from the Company and who are using credit cards are required to agree to and sign the following statement:

"The Cardholder hereby authorizes the Company to charge any and all purchases to the credit card number provided. The Cardholder certifies that the Cardholder is the owner and authorized signatory on the credit card provided. The Cardholder is legally able to provide this information to the Company and that persons not listed on the credit card may accept and sign for packages upon delivery on behalf of the Cardholder. The Cardholder has read and agrees to the sales and returns policies of the Company. This authorization shall remain in effect until canceled by the Cardholder in writing and the Company receives such cancellation.".

Sales Policies

The Company ships domestically via UPS, FedEx; and the Company ships worldwide via UPS, FedEx and U.S. Postal Service Global Express Mail.

In-stock orders must be received by 3:00pm Central Standard Time to be processed and shipped the same day. If the Company is temporarily out of stock of an item, the entire shipment may be delayed or shipped partially.

UPS and FedEX do not ship to Post Office Boxes. To ship to Post Office Boxes inside the United States, please select U.S. Post Office as your desired shipping method.

UPS and FedEx may require a signature upon delivery of your shipment.

Our business hours are Monday through Friday 8:00am to 6:00pm (Central Standard Time) except for Holidays. Web orders placed on Saturday or Sunday or after 3:00pm (Central Standard Time) Monday through Friday will be processed on the following business day.

All shipping times (one-day, two-day and three-day etc) are based on business days Monday-Friday, excluding holidays.

Motorcars LTD reserves the right to select the most economical form of shipping based upon the purchaser's preference of timed delivery.

The customer is responsible for all freight costs, storage, international duties or customs costs or special handling costs associated with all orders and / or returns.

Warranties

New and Remanufactured Parts Warranties

New and Remanufactured parts carry a 12 month warranty from invoice date with a "repair or replace" warranty - at the option of the Company.

Extended warranties and labor warranties may be purchased separately for an additional charge on selected remanufactured and salvaged parts. Please contact your salesperson for more information.

In the event of a part's failure, the Company specifically denies any liability for the damage to associated parts, consumables or the labor to replace such defective parts. No liability beyond replacement of goods is accepted or implied. No labor warranty expressed or implied.

Salvage (Used) Parts Warranties

Used parts can be an affordable option but are not always the best choice in certain circumstances. Please make sure you understand what you're buying when you purchase Salvage (Used) parts.

Used parts carry a 99 day warranty from invoice date with a "repair or replace" warranty at the option of the Company.

Extended warranties and labor warranties may be purchased separately for an additional charge on selected remanufactured and salvaged parts. Please contact your salesperson for more information.

In the event of a part's failure, the Company specifically denies any liability for the damage to associated parts, consumables or the labor to replace such defective parts. No liability beyond replacement of goods is accepted or implied.

Only in the instance that the Company cannot repair or replace the defective salvage (Used) part will a warranty result in a refund.

No returns on used parts.

Returns Policies

The Company will not accept C.O.D. returns.

A copy of the original invoice must accompany all returns.

Customer must obtain a Return Authorization Number (RAN) prior to returning any items. Returns without a RAN are subject to a $25 fee charged against the refund (excludes cores - see below).

Items NOT Returnable

Special Order parts are NOT returnable.
Salvage parts are NOT returnable.
Books and manuals are NOT returnable.
Parts, which have been installed, plugged-in, or marked in any manner, are NOT returnable.
Electrical parts are NOT returnable unless unopened in the original packaging.
Tools are NOT returnable.
Items not purchased from the Company.
All parts purchased over 90 days except in the case of defective items.

New and Remanufactured Parts Returns

New parts and Remanufactured parts carry a 30-day return policy from invoice date and are subject to a 15% restocking charge. After 30 days, a 25% restocking charge is charged. The 25% restocking charge may be reduced to 15% if the customer agrees to accept Store Credit in lieu of a refund.

No returns of parts purchased after 90 days.

All returned parts must be in saleable condition and in their original boxes. Dirty and greasy boxes are not returnable.

Special Order parts are not returnable.

Parts that have been installed, plugged in or marked in any manner are not acceptable for return.

Electrical parts are not returnable.

A Return Authorization Number (RAN) must be obtained from customer service at 1-800-338-5238 ext. 129 prior to any return. A $25 dollar charge will be applied against the refund on any returns without a RAN. All calls will be returned between 8:00am to 1:00pm the following business day.

Salvage (Used) Parts Returns

Salvage (Used) parts are NOT returnable.

Core Returns

Cores must be complete, fully assembled and in rebuildable condition in order to receive core credit. A box of parts does not constitute a rebuildable core. A part requiring welding does not constitute a rebuildable core.

Upon receipt, the Company will inspect the core and refund the core charge less whatever non-wear parts are broken, missing, or damaged. Cores requiring welding may be fixed at the customer's option in order to make the core "rebuildable". Charges for repairing a core are deducted from the core refund.

If the customer refuses to repair a core to make it rebuildable, the core will be returned to the customer, freight collect and no core refund will be made.

Cores must be returned within 90 days. After 90 days, a 25% late charge will be deducted from the core refund.

Salvage (Used) cores associated with the sale of Salvage (Used) parts need only to be complete and assembled.

All cores must be returned in the original manufacturer's box.

Cores returned must be the same as the unit sold.

Ratios of differential units returned must be the same as the ratio sold.

The customer is responsible for the return of the core. The cores should be packed carefully for return in order to protect the core from shipping damage. The Company is not responsible for shipping damage.

Rejected cores will be returned to the customer freight collect and no core refund will be given.

Partial core credit will NOT be given for partial or damaged cores. See above for terms of core repairs.

Cores can be returned using your original invoice number as the return authorization number.

Shipping Damage

Damaged shipments are the responsibility of the carrier. Check all shipments before you sign for them. If your shipment arrives damaged, you must note that fact on your receipt/bill of lading and have the driver acknowledge with their signature. The Customer must report shipping damage to the carrier and to our Company within ten days of receipt of goods. The Customer is responsible for initiating all freight claims with the carrier.

Claims for shipping damage or damaged merchandise will be issued only after all issues are settled with the carrier.

Return Procedures

Need to Return a Part? (Ordered Wrong or Sent Wrong)

Call customer service at 1-800-338-5238 ext. 129 prior to returning the parts.
The Company will issue a Return Authorization Number (RAN). This RAN must be written on the outside of the returned package. If there is no RAN on the outside of the box, the Company will apply a $25 charge against the refund amount. When returning any part to us, include a photocopy of the original invoice.

New and Remanufactured Parts are returnable for 30 days subject to a 15% restock fee. After 30 days from invoice date there will be a 25% restock charge. After 90 days, parts are not returnable.

Salvage parts are not returnable. Salvage defects are covered by a 99 day warranty to replace or to repair at our option.

It is the customer's responsibility to insure that goods are packaged properly to prevent shipping damage.

Need to Return a Part? (Defect)

Call customer service at 1-800-338-5238 ext. 129 prior to returning the parts.
The Company will issue a Return Authorization Number (RAN). This RAN must be written on the outside of the returned package. If there is no RAN on the outside of the box, the Company will apply a $25 charge against the refund amount. When returning any part to us, include a photocopy of the original invoice.

In the case of defects, the Company has the option to replace, repair or refund parts.

Replacement shipping is covered only if the part upon installation, not subsequently.

It is the Customer's responsibility to complete the attached "defective parts return fact sheet" for each part being returned. Do not write, "does not work" as a reason for defective merchandise. Explain why the part does not work or what the part does not do.

When returning any part to us, include a photocopy of the original invoice.

It is the customer's responsibility to insure that goods are packaged properly to prevent shipping damage.

Need to Return a Part? (Damaged in Shipping)

Call customer service at 1-800-338-5238 ext. 129 prior to returning the parts. It is the responsibility of the customer to report any and all damage to the freight company or delivery driver. Any and all shipping damage must be reported to our Company within 10 days of Customer's receipt of goods. Please make note of any "visible damage" on the delivery ticket, or the freight carrier may not honor a freight claim. For "hidden damage", keep all packing material, box(s), etc. for a freight representative to review. Failure to keep all packing material or report damage will void any and all freight claims.

Call Tags

A service charge of $6.00 plus freight cost will be deducted from any credit refund to cover call tag return service.

CUSTOMERS ARE REPSONSIBLE FOR RETURN FREIGHT CHARGES.

The Company will not accept C.O.D. returns.
